How to Register Your Business Name

An LLC name is officially registered when you file your LLC application documents and form an LLC.

Registering a DBA in New Hampshire (also known as a trade name) is a separate process that requires filing with the Department of State.

Reserve Your Name

You can optionally reserve your LLC name in New Hampshire for up to 120 days before you officially register it. This prevents other businesses from registering your name until you have the opportunity to register it yourself. 

Name reservations can be filed online or via hard copy with the New Hampshire Department of State. The filing fee is $15.

New Hampshire Naming Requirements

Some key guidelines for New Hampshire LLC names include:

  • Your name must include the phrase “Limited Liability Company” or one of its abbreviations (LLC or L.L.C.).
  • Your name may contain the name of a member or manager of the LLC.
  • Your name must be distinguishable from any existing business in the state. This includes New Hampshire reserved names.

Keep an eye out for restricted words. These words, such as “FBI” or “Treasury,” are often restricted to keep your LLC from sounding like an official institution.

New Hampshire also has the following restrictions for LLC names:

  • Your name cannot imply that the LLC was organized for any non-permitted purpose or one not outlined in its certificate of formation.
  • Your name cannot include the name of a political party without authorization.
  • Your name cannot include the words "farmers' market" unless the LLC meets the definition of a farmers' market.

Distinguishability

It is important that your name be distinguishable from all other business names. In New Hampshire, a distinguishable name is one that is substantively different from all other existing or reserved business names in the state.

The following differences do NOT make a name distinguishable in New Hampshire:

  • Plural forms
  • Phonetic spellings
  • Abbreviations
  • Prefixes and suffixes (excluding antonyms)
  • Business entity type designators
  • Numeric designation
  • Punctuation and special characters
  • Spacing
  • Numerals vs. spelled out numbers
