Before you do a name availability search, it makes sense to check if your business name meets the basic state guidelines.

Some key guidelines for Maine LLC names include:

  • Your name must include the phrase “limited liability company” or “limited company” or one of their abbreviations (LLC, L.L.C., L.C., LC).

  • Low-profit LLC names must include "Low-profit Limited Liability Company, "L3C," or "l3c." 

  • Your name must be distinguishable from any existing business in the state. This includes Maine reserved names.

Keep an eye out for restricted words. These words, such as “FBI” or “Treasury,” are often restricted to keep your LLC from sounding like an official institution.

Maine has the following restrictions for LLC names:

  • You must get approval from the Maine Bureau of Financial Institutions to include any of the following words in your name: savings, savings bank, bank, banker, banking, trust, trust company, trust and banking company, and credit union (or any plurals or variations).

  • Your name cannot include obscene language. 

  • Your name cannot promote abusive or unlawful activity.

  • Your name cannot falsely suggest an association with public institutions.

It is important that your name be distinguishable from all other business names. In Maine, a distinguishable name is one that is substantially different from the name of any other business as well as any reserved name.

In Maine, the following differences are NOT considered sufficient to make a name distinguishable:

  • Business entity type suffixes (e.g., LLC, Corporation, Company)
  • The use of “and” or “the”
  • Differences in punctuation or capitalization

Failure to use a distinguishable name could result in your formation filing being rejected.

How to Reserve or Register Your Business Name

Reserve Your Name

You can optionally reserve your LLC name in Maine for up to 120 days before you officially register it. This prevents other businesses from registering your name until you have the opportunity to register it yourself.

Name reservations can be filed via hard copy with the Maine Secretary of State. The filing fee is $20.

Register Your Name

If you want to register a legal entity name for your LLC, you can do so at the time of formation filing. Maine provides a section for your desired LLC name on the Certificate of Formation.

Registering a DBA (doing business as) name, called an assumed name in Maine, is a separate process that requires filing with Secretary of State.
